Privacy Policy

This privacy policy (“Privacy Policy“) sets out the terms and conditions of data processing by Movie Games Spółka Akcyjna with its registered office in Warsaw.
Movie Games Spółka Akcyjna respects your privacy and provides you with this Privacy Policy so that you understand the ways in which we do and do not use the personal data you transmit when accessing and playing our games, accessing and using the websites, platforms and related to the games services (hereinafter the “Games”).
This Privacy Policy applies only to personal data submitted and collected online through or in relation to the Games and the Games platforms.

The Data Controller is Movie Games Spółka Akcyjna with its registered office in Warsaw, ul. Wernyhory 29A, 02-727 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the m.st. of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number: 0000529853, REGON: 360126430, NIP: 5272723755, share capital in the amount of PLN 2,573,132.00 paid in full.

1. Purpose and scope of personal data collection and legal basis for personal data processing

We collect personal data for the following purposes:

1.1. Purposes related to the Games

a) We collect and process personal data in order to provide you with the Games, in particular to allow you access and play the Games (for example personal data such as your name, your email address, account login which you provide creating an account on the platform that hosts the Games).
b) The Data Controller and/or service payment provider also collects and processes personal data relating to financial information in connection with the Games. The Data Controller does not use this financial information for any purpose other than processing payments.
We collect and process this personal data mentioned in points a) and b) in order to fulfill our contractual obligation to you.
c) The Data Controller will also collect and process other types of personal data when you interact with the Games online, such as yours type of the browser, the operating system, the IP address, the data concerning your device (e.g. computer) that you are using to access and play the Games, your unique Player-ID.
d) You may also voluntary provide additional personal data such as nickname in the Games, personal profile in the Games and/or any other your personal data concerning and/or connecting with the Games.
We collect and process this personal data mentioned in points c) and d) in order to provide you with the highest quality of services and the legal basis for this is legitimate interest.
We process abovementioned data for such a period, which is necessary for the purposes described above and for evidence purposes, securing claims or defending against them.

1.2. Newsletter

We process personal data in order to send the newsletter to people who have agreed to receive it. We store such data until you revoke your consent.
We use Mailchimp services to send the newsletter. You can read the privacy policy and cookie policy of this entity here: https://www.intuit.com/privacy/statement/ If you subscribe to the Newsletter, then the data related to this subscription are transferred to the mailchimp account registered by Movie Games S.A., and therefore the recipient of your personal data in this subject (i.e. to the extent to which they come from the Newsletter) will be Movie Games S.A.

1.3. Direct marketing

If you are a representative of our client or business partner, or a person with whom we contact in connection with cooperation with such an entity, we may process your personal data for the purpose of contact (in paper form) bearing the hallmarks of direct marketing (by sending occasional correspondence). Such direct marketing is our legitimate interest and we process the data for this purpose for the duration of our cooperation.

1.4. Data analysis tools

On the website www.moviegames.pl we use analytical tools to track website traffic and optimize the site based on the collected data. The primary tool used for data analysis is Google Analytics, provided by Google, Inc. 1.4.1. Google Analytics

In order to create the best possible user experience on the website www.moviegames.pl Google Analytics is used. Google Analytics uses text cookies stored on your computer and mobile devices to enable us to analyze website usage in order to provide you with the best possible experience. Cookies generate information that is sent to the servers of Google, Inc. The data stored on the server will be anonymized and then used for behavioral analysis, reporting, or other services related to improving the user experience on the website.
The data collected using text cookies provided to the Google Analytics service include, m.in, browser type, operating system, referral URL, IP address, time spent on the website, visited subpages, bounce rate, or time of sending a request to the server. This data is stored on the servers of Google, Inc.
In order to create the best user experience on the website, in order to combine the services provided by Google, Inc., it is also possible to use the Google Tag Manager service on the website, which allows you to manage tags related to the services provided by Google. This tag does not collect personal data, but it may lead to the activation of other tags or tracking codes that collect such data within the tools provided by the Google, Inc.

Our legitimate interest in processing this data also arises from the above purposes. With regard to the exceptional transfer of your personal data to the USA, Google , Inc. has committed to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
We transfer to Google Analytics information collected by means of cookies (statistical information) and which are sent to the servers of Google, Inc. This information is anonymous. You can read more about the processing of such information here: https://policies.google.com/privacy

1.4.2. Google Analytics

On the website www.moviegames.pl an external library of web fonts is used, which is provided by Google, Inc. in the form of API and files made available on the servers of Google, Inc. downloaded from: fonts.googleapis.com and fonts.gstatic.com. When you access the website, you load the fonts directly from a server of Google, Inc. (fonts.googleapis.com or fonts.gstatic.com), which are then added to your browser’s cache. In order to ensure a smooth use of the website, the user is obliged to connect to Google servers in order to display online fonts that are indispensably related to the graphic style used on the website. We use the following web fonts on our website in the form of files containing web fonts provided and hosted by Google, Inc., and these are:

  • Font Family: Prata
  • Font Family: Roboto
  • Font Family: Roboto Slab

Our legitimate interest in processing this data also arises from the above purposes.

2. Data collection sources

We collect data directly from you, in particular when you access the Games, make payments, interact with the Games online.
We may also obtain your data from platforms that hosts the Games, according to their regulations, policies, terms and conditions.

3. Data recipients

Personal data may be transfer, disclose and/or share with:
a) partners, affiliates, subcontractors, employees and associates of the Data Controller, third parties who facilitate the operations of the Games, entities providing support to the Data Controller on the basis of commissioned services (e.g. software providers), entities with the help of which we maintain the IT infrastructure – only to the extent that it is necessary in connection with the performance by the Data Controller contractual obligation to you and/or to provide you with the highest quality of services, in particular in order to provide the Games and related services,
b) entities authorized to obtain data under applicable law, e.g. courts or law enforcement authorities – only in the event of receiving a request based on an appropriate legal basis,
c) other entities than indicated in point a) and b) above – only to protect the rights, property or safety of the Data Controller, the Games and end users and/or for defense of any lawsuit, investigation or other actions if such personal data are relevant to a lawsuit, investigation or action.

When you register an account on the platform that hosts the Games, you create your own profile and privacy settings. Your name, email and profile picture may be displayed to others in the networks, depending on your privacy settings.
When you use the Game, certain information you post or share with third parties (e.g., a friend or someone in your social network), such as personal data, comments, messages, photos, videos, or other information, may be shared with other end users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal data in your profile or when posting comments, messages, photos, videos, or other items, this information may become publicly available.

4. Your rights regarding your personal data

You have the right to access your personal data and the right to rectify, delete or limit processing, as well as the right to transfer data and the right to object to processing.
Access and control over most personal data in the Games are readily available through the profile editing tools on the web page or the gaming platforms. You may modify or delete any or all of your profile data at any time by logging into your account.
If you wish to deactivate your Games account you may do so in your account settings, either on the web page or the gaming platforms. Removed information may continue to exist in backup copies but will not be generally available. You cannot, however, remove communications made in the communication features in the Games, which have been shared with other end users (for example sending personal messages to another end user).

5. Request deletion of personal data

You have the right to request immediate deletion of your personal data, and the Data Controller is obliged to delete your personal data without undue delay if one of the following circumstances occurs:
a) the personal data is no longer necessary for the purposes for which it was collected or otherwise processed,
b) with regard to the data concerning you – you withdraw the consent on which the processing is based and there is no other legal basis for the processing,
c) with regard to the data concerning you – you effectively object to the processing and there are no overriding legitimate grounds for the processing,
d) the personal data was processed unlawfully,
e) the personal data must be deleted in order to comply with a legal obligation.
 

6. Voluntary provision of data

Providing personal data is voluntary, however, failure to provide certain personal data in situations where it is necessary may result in the inability to performance by the Data Controller contractual obligation to you and/or to provide you with the highest quality of services, in particular in order to provide the Games (e.g. to allow you access and play the Games) and related services.

7. Data transfers to third countries or international organizations

We do not intend to transfer your personal data to a third country or an international organization.
However upon certain circumstances we may transfer your personal data to a platform that hosts the Games and/or its owner and/or its agency, branch, office, representative, managing entity, etc. and which has its registered office in non-EU country and/or through which operates in non-EU country (e.g. at the request of this platform) therefore in this way your personal data will be transferred to that third country and/or mentioned entity.

8. Automated decision-making, including profiling

We do not make decisions based on automated processing of personal data, nor do we profile personal data.

9. Right to lodge a complaint

You have the right to lodge a complaint with the supervisory authority in the field of personal data protection, i.e. the President of the Personal Data Protection Office, address: ul. Stawki 2, 00-193 Warsaw, Poland, regarding the Data Controller processing of your personal data.
