We reserve the right to use your content or its fragments produced as a part of this project for marketing purposes – specific rules for this use are set out below in the General Terms of Use.
The content you produce must adhere to the copyright laws of Poland.
We reserve the right to expel a member from the Gang.
We reserve the right to collect your information and use it for purposes connected with running the Movie GameRs Gang.
By signing up you agree to mark your content appropriately in the case of games intended for mature audiences, such as Drug Dealer Simulator or Lust from Beyond.
In the cases indicated in points 4 and 8 above you are not allowed to use in any way, any of the games of Movie Games spółka akcyjna using a game key received from us in connection with your accession to Movie GameRs Gang. Violation of this prohibition may result in your legal liability.
General Terms of Use:
By signing up for the Movie GameRs Gang, you agree to the principles set out in this document, in particular in this General Terms of Use (hereinafter referred to as the “GTU”).
You can use the games of Movie Games spółka akcyjna with its registered office in Warsaw (02-727), ul. Wernyhory 29a (hereinafter referred to as the “Games”), only for the purpose of producing content with it – either a video or a stream and tagging us on social media (Facebook, Twitter, Instagram and/or TikTok) – this content is collectively hereinafter referred to as the “Work”.
Any copying, modification, processing, distribution or other use of our Games for purposes other than those specified in point 2 above of this GTU, in whole or in part, without our express written consent, is prohibited. Copying, modifying, processing, distributing or otherwise using our Games for purposes other than those specified in point 2 above of this GTU may result in your liability under applicable Polish law.
By signing up for the Movie GameRs Gang you confirm that you are an adult person. Only an adult person may participate in the Movie GameRs Gang.
The Work you produce must be legible, unblurred, visible and uncropped.
The Work must be original, unregistered and invented by yourself. Moreover, by producing the Work, you represent and warrant that the Work: is created solely by you and has not been previously published anywhere; that you are the sole author and have all rights to it; that you have not authorized any third party to use it or to exercise any rights therein on your behalf.
Upon the creation of any Work, you grant the Movie Games spółka akcyjna, without any territorial restrictions, an exclusive license to the Work, including all elements that make up the Work, to use the Work in any way for the needs of the activities of the Movie Games spółka akcyjna related to any marketing activities of the Movie Games spółka akcyjna, in particular, release and distribution of the Games and placing the Work in any way in marketing materials (hereinafter referred to as the “License”). In connection with granting the License, you and Movie Games spółka akcyjna agree that the License is granted in the following fields of exploitation:
in the scope of recording, using, storing and multiplying the Work in whole or in part, without any quantitative restrictions - in the memory of a computer or other machines and in multimedia and Internet networks, as well as the production of copies of the Work using a specific method or technique, including printing, reprographic, electronic, magnetic recording and any available digital technique;
in the scope of trading in the original or copies on which the Work has been recorded - marketing, lending, lease or rental of the original or copies, as well as exchange of any media on which the Work or its fragment has been recorded;
distribution, in particular, traditional and digital distribution, dissemination and trading of the Work via appropriate digital distribution platforms and in traditional distribution networks or computer games, without territorial restrictions due to the global reach of sales platforms and enabling the introduction of the Work for sale in accordance with the provisions of this point, in particular, adapting the Work to the requirements of the digital or traditional distribution network;
in the scope of disseminating the Work in a manner other than specified in points 2) and 3) above - public performance, exhibition, display, reproduction, broadcasting and re-broadcasting, including by means of sound or vision, in a wireless manner (terrestrial and satellite) or by wire, analogue or digital in any system and standard, including via cable networks and digital platforms, as well as making the work available to the public in such a way that anyone can access it from a place and at a time individually chosen by them, including sharing electronically on demand, including dissemination on the Internet and in closed networks, as well as any other sharing of the Work;
permanent or temporary reproduction of the Work in whole or in part by any means and in any form, without requiring additional consent;
translation, adaptation, layout changes, disassembly, decompilation or any other changes to the Work;
dissemination, including lending or rental of the Work or its copy, at any time specified by Movie Games spółka akcyjna;
selling, transferring, making available to the public on the basis of exclusive or non-exclusive licenses and using the Work in any other way and unrestricted disposal of the Work at the discretion of Movie Games spółka akcyjna;
introducing any changes to the Work, developing or creating Work abbreviations, and disseminating them after such modifications, without the requirement to obtain additional consents, including in the scope of works being elements of computer software;
The way of using the License described in point 7 of the GTU entitles Movie Games spółka akcyjna to authorise other entities to use the License, including the Work, in particular by sublicensing, leasing, renting or free use, without the need to obtain the prior consent from you.
The License is granted free of charge.
The License is granted for a definite period of time from the date of your creation of the Work, for 5 (five) years, and after 5 (five) years of the License's validity, the License is transformed into a License granted for an indefinite period. After 5 (five) years of validity of the License, the License may be terminated with 36 (thirty-six) months’ notice, effective at the end of the calendar year. Moreover, Movie Games spółka akcyjna also has the right to terminate the License with immediate effect at any time, and in particular when the continuation of the License lost economic or business sense for Movie Games spółka akcyjna, including is pointless, uneconomic or unprofitable. In the event of the ending of the License, Movie Games spółka akcyjna is not obliged to remove or modify any materials (from any platforms, websites, social media, marketing materials etc.) in which the Work was used during the License period.
You also grant Movie Games spółka akcyjna the License to your nickname and logo, on the terms and conditions indicated in points from 7 to 10 of this GTU.
In case the Work contains your image or your name or surname, you agree to use it by Movie Games spółka akcyjna in connection with using the License by Movie Games spółka akcyjna and for the period for which the License was granted. In the event of the ending of the License, Movie Games spółka akcyjna is not obliged to remove or modify any materials (from any platforms, websites, social media, marketing materials etc.) in which your image or your name or surname was used during the License period.
In case of misleading Movie Games spółka akcyjna as to the representations and warranties with regard to the Work produced or your personal data, you must take into account the possibility of incurring legal liability arising from this.
Any changes to this GTU require a written statement of changes, made by Movie Games spółka akcyjna, to be valid under pain of nullity.
This document, in particular the GTU and the License granted are governed by the law of Poland. To the extent not regulated in this document, in particular, in the GTU, the provisions of generally applicable Polish law shall apply.
